An elderly Brockton couple was hurt recently in a rear-end collision caused by an alleged drunken driver in West Bridgewater. According to local police, 39-year-old Brian McManus of East Bridgewater hit the back of a Toyota Camry driven by 75-year-old Eleanor Costa as she headed east on Route 106. McManus was allegedly speeding when he rear-ended Costa's vehicle. Sergeant Kenneth Bryant stated the force of the impact caused Costa's vehicle to overturn and roll at least twice. McManus then purportedly drove across the oncoming traffic lane and into the parking lot of a restaurant where Bryant stated the man's car hit both a stone wall and a corner of the building.
Following the crash, rescue crews reportedly transported Costa to a Boston hospital with a serious head injury. Her 82-year-old husband, Louis, was taken to Good Samaritan Medical Center with unknown injuries. Despite several impacts, McManus was purportedly uninjured in the incident. Because McManus allegedly smelled of alcohol, West Bridgewater Police Officer Daniel Desmond arrested him at the scene of the accident. McManus was later charged with driving under the influence of alcohol and causing serious injury to another person, reckless driving, and speeding.
Rear-end accidents are quite common in Massachusetts. Unfortunately, insurance companies normally work hard to deny the personal injury claim of someone who was struck from behind by another driver. When a motorist is hit from behind by a car, truck, or other motor vehicle, he or she may suffer a neck injury, a spine or other back injury, broken bones, and damaged nerves. As was the case here, serious head injuries also frequently accompany a rear-end collision. In addition, some injury accident victims suffer from connective tissue trauma such as whiplash. Such injuries may cause crippling headaches as well as other temporary or lifelong pain.
The victim of a drunk, inattentive, or otherwise negligent driver may be entitled to collect financial compensation for their medical costs, any resulting disability, pain and suffering, lost wages, and other damages. Certain family members of someone who was killed by a drunk or reckless driver in Massachusetts may also be eligible to collect additional damages such as funeral expenses. Someone who was hurt in a Massachusetts car accident may also be eligible to receive Personal Injury Protection or underinsured motorist benefits from their insurance company.
